What Is Robbery?

Unlike burglary where a person takes property from a dwelling or commercial structure, a robbery is the taking of property by force from a person. An example could be someone going into Central Park and accosting the victim with a gun. It does not involve any kind of dwelling or structure. Robbery is taking property from a person rather than from an unoccupied building.

Robberies have different degrees, such as:

  • Class D felony: This is the lowest degree of robbery, which is the taking of property from somebody by pushing them or threatening them with harm. There is no weapon, so it is not considered as severe. Sentences could be from two to seven years in prison.
  • Class C felony: Caused by serious injury or threats of serious injury that involve brandishing a weapon. This could result in 7 to 15 years in prison because it is a violent robbery.
  • Class B felony: With prison sentences ranging from 10 to 25 years, these robberies involve serious injury to a person or involve a gun.
