Interviewer: Are people eligible for ADP only on their first crime or second crime? Does it depend on the crime as well?
Stuart: That is an interesting question. Technically, it is supposed to be for your first crime because somebody who does this 10 times does not deserve the break.
However, suppose on their first crime someone completes this program and passes all the hurdles to get their case sealed. So when the same thing happens six months later, technically no one knows that it happened. This is because it has all been sealed. All the records are sealed and everything is done.
So there is that possibility that somebody could go through the ADP Program two, three, four times without ever putting up a red flag. I do not see that happening, but yes it could.
