NEW ROCHELLE – A 47-year-old man was caught while driving under the influence with 4 children in his car. He belongs to New York City.
Jose Ortiz-Gonzalez was travelling with his four kids, two of whom were less than 15 years of age. The incident took place at New Roc City on Friday at 1 a.m.
According to Leandra’s law, it is a felony to drive drunk with children under the age of 15 years in a car. New Rochelle police Sgt. Myron Joseph said that Ortiz-Gonzalez of 230 E. 123rd St. in Manhattan was driving under the influence with his 10-year old daughter and 7-year-old son in his car which is a violation of the state’s Leandra Law.
There were two more children with Ortiz-Gonzalez in his car; his 17-year-old son and 18-year-old daughter. His car was stopped by the police in the parking lot of New Roc City at 1 LeCount Place.
The family was travelling in a 2013 Honda Accord after leaving Applebee’s Restaurant. Sgt. Joseph told that police officers responded after receiving a call from an unidentified caller who told that he saw an intoxicated person attempting to drive away with his children in the car.
After stopping Ortiz-Gonzalez’s car, cops gave him a field sobriety test which he failed.
Jose Ortiz-Gonzalez was charged with driving under the influence, a felony and endangering the welfare of a child, which is a misdemeanor.
After arresting Ortiz-Gonzalez, the children were turned over to their mother.
